Summary of 2017 Athlete's Working Contract Forum

作为体育竞赛的主体,运动员一直备受关注。随着体育改革进程的加快,运动员合同问题更为复杂,争议不断增多。为回应社会热点,中国法学会体育法学研究会特举办了"运动员工作合同"专题论坛。围绕该项议题,论坛就运动员工作合同的性质、条款、争议以及国际比较进行了专题研讨。与会人士形成主流认识,职业运动员工作合同从整体上看属于劳动合同,但具有自己的特殊性。论坛呼吁充分尊重竞技体育和职业体育的发展规律,注意职业运动员工作合同的特殊性,期望在法律法规、国际体育组织规则、理论研究、实践积累的基础上,寻求解决职业运动员工作合同中的问题。论坛还关注了我国优秀运动员的合同、其他类型运动员的合同。

The athletes have received public attention for they are the most important persons in a sports competiton. With the speedup of the sports reform, the problems of athlete＇s working contract have become more complicated. In order to respond to this social issue, the Chinese Law Association has hosted the Athlete＇s Working Contract Forum. The forum attendants have reached common conclusion that the professional athlete＇s working contract is generally a labor contract with its own features. The forum advocates to respect the developing rules of competitive sport and professional sport and pay attention to its features, so as to solve the athlete＇s working contract problems based on law, international rules, the- oretical research and practice. The forum also discusses the contract of excellent athletes in China and the contract of other types of athletes.
