温州民间融资规范问题研究

Research on Standardizing the Private Financing in Wenzhou

2013年11月,浙江省人大常委会审议通过全国首部规范民间金融的地方性法规《温州市民间融资管理条例》。自2014年3月条例及其实施细则生效以来,温州民间融资出现了很多新业态、新变化,也发生了一些民间金融风险案件。从民间融资价格、传统民间融资及民间融资新业务等角度调查温州民间融资现状,分析当前温州民间融资规范存在的问题,有助于进一步研究温州地方金融规范及监管问题。进一步规范发展温州民间融资,应区别监管个人和机构民间融资、修订完善监管法规、强化公检法在民间融资规范中的作用、将民间融资信息纳入征信系统、构建民间融资与正规金融系统风险隔离机制。

In November 2013,the Standing Committee of Zhejiang Provincial People＇s Congress examined and adopted The Regulations on the Management of Private Finance in Wenzhou,the first local standard of civil finance.Since the regulation was implemented in March 2014.there have been many new formats and new changes in Wenzhou private financing in recent years.There also have been some cases of private financial risk.This paper analyzes the current situation of private financing in Wenzhou from the perspectives of private financing prices,traditional private financing and new private financing.If want to further regulate the private finance,it should put forward the difference institutional and private financing,revise and improve supervision and regulations,strengthen the public security law in the role of private financing norms,putthe private financing information into the credit system and construct the mechanism of isolation of risk of private finance and regulate finance system.
