全域旅游之法治保障

The Legal Guarantee for Global Tourism

全域旅游作为供给侧结构性改革和"互联网+"理念引领之下旅游业转型日益明晰的目标,正由一般概念与理论探讨向具体实践迈进,由过往旅游实践隐含要素演变成不断开展的实践模式。全域旅游实践中,旅游关系在悄然发生深刻变动,旅游秩序将面临重构。尽管我国颁行了《旅游法》,然而调整变动着的旅游关系与旅游秩序的规范侧重于国家政策,与全域旅游相适应的法治保障未予到位。在任何改革都必须于法有据的今天,法律规范效力高于任何其他规范,法治是全域旅游实践发展的有力保障。具体来说,坐实旅游综合协调机制是全域旅游法治保障之基石;旅游政策法律化是全域旅游法治保障之核心;创新旅游市场监管机制是全域旅游法治保障之关键。

The goal of global tourism as a supply-side structural reform and the concept of uIn-ternet ＋ ’’ under the leadership of the tourism industry is being explored by the general concept and theory to concrete practice, and the implicit elements of tourism practice have evolved into continu-ous practice mode. In the global tourism practice, the tourism relationship is quietly changing, and the tourism order will face the recon- struction. Although China has promulgated the “ Tourism Law”,but to adjust the changes in tourism and tourism order norms focus on national policy, and the global tourism to adapt to the rule of law protection is not in place. In any reform must be lawful today, the legal norms of effectiveness than any other norms, the rule of law is a strong guarantee for the development of global tourism practice. In particular, the comprehen-sive coordination mecha-nism of tourism is the cornerstone of the global tourism rule of legal guarantee ; the legalization of tourism policy is the core of the global tourism legal protection; innovation tourism market supervi-sion mechanism is the key to the protection of the whole tourism law.
