摘要
民法典编纂时,劳务派遣单位侵权责任应当以控制因素为判断标准,主要是对劳动者在劳动过程中劳动行为的控制,包括管理和监督。如果劳务派遣单位控制着劳动者的劳动行为,那么劳务派遣单位应当承担雇主替代责任,用工单位无需承担侵权责任。如果劳务派遣单位没有控制劳动者劳动行为,而是用工单位控制劳动者行为,那么由用工单位承担侵权责任,派遣单位无需承担补充责任;派遣单位对选任有过失,需对用工单位承担相应的侵权责任。
When the civil code is compiled, the tort liability of the labor dispatch unit should be judged based on the controlling factors, which, embodied as management and supervision, mainly include the control of the behavior of laborer in the process of labor. If the labor dispatch unit controls the laborer' behavior, the labor dispatch unit shall bear the substituted responsibility of employer, and the employing unit shall not bear the tort liability. And the reverse is also true, whereas labor dispatch unit shall not bear supplementary liability. In addition, if the dispatch unit is negligent on the election, it should bear the corresponding tort liability.
