摘要 同业监督是经营者监督同业竞争者经营活动是否符合竞争法的行为。其直接目的是维护监督者的正当竞争利益,并达到维护消费者利益和市场竞争秩序的效果。同业监督内容丰富,表现形式多样。同业监督是市场主体自我规制以及经营者积极行使竞争权利的表现。专利权无效宣告制度、反垄断宽恕政策等法律规则均是对同业监督的立法肯定。同业监督的竞争法规制需要考虑行为人的主观心理状态、行为是否具有科学依据、行为形式是否合理以及行为的积极效果与消极影响比较等因素综合判断。为发挥市场主体积极维护良好市场竞争秩序的作用,竞争法应对同业监督持允许和褒扬态度。 The purpose of peer supervision is to supervise whether the activity of competitors meets the spirit of the competition law. The direct purpose of peer supervision is to safeguard the legitimate competition interests of supervise actors. Peer supervision can also to safeguard consumer interests and market competition order effect. There are many content and forms of peer supervision. Peer supervision is the performance of self-regulation of market play- ers and exercise of compete right actively. Invalidation system of patent law and leniency program of anti-monopoly law are the affirmation to peer supervision. From the perspective of competition law, regulations on peer supervision should consider the perpetrator's subjective state, the scientific basis and the forms of behavior, and positive effects and the negative effects of behavior. Competition law should allow and praise peer supervision so as to encourage market players to play an active role in maintaining good market competition order.
