民营企业社会责任的实证研究——基于安徽省的经验数据

An Empirical Study on Social Responsibility of Private Enterprises——Based on the Experience Data of Anhui Province

文章基于社会责任内容的不同,将民营企业社会责任类型化为法律、经济和社会三个方面,并将社会责任的不同类型层次化为基本社会责任、必要社会责任和更高层次社会责任。通过对安徽省民营企业社会责任履行情况的实证研究,发现当前安徽省民营企业履行社会责任存在主观意愿因社会责任类型而不同、履行社会责任的客观程度与社会责任层次呈负相关以及履行社会责任的效果与规范的约束力呈正相关等失衡和无序问题,其主要原因在于约束性规范的不力和促进性规范的不畅。就法律规制而言,发挥强制性规范、任意性规范和促进性规范对各类社会责任的约束和引导,强化正式制度对民营企业履行社会责任的他律,实现民营企业履责的有序和协调。

According to the different contents of social responsibility, social responsibility of private enterprises is typed as legal, economic and social aspects, And different types of social responsibility can be classified as basic social responsibility, necessary social responsibility and higher social responsibility. The paper discovers that, by making an empirical study on the performance of social responsibility of private enterprises in Anhui province, there are imbalance and disorder and other problems, such as the subjective willingness varies with different types of social responsibility, the objective degree of fulfilling social responsibility is negatively correlated with the level of social responsibility, the effect of fulfilling social responsibility is positively correlated with the binding of norms, etc. The main reason lies in the weakness of binding norms and the obstruction of promoting norms.As far as the legal regulation is concerned, the government should give full play to the role of mandatory norms, arbitrary norms and promoting norms to restrain and guide all types of social responsibility, strengthen the heteronomy of formal institution on the performance of social responsibility of private enterprises, and achieve the order and coordination of private enterprises fulfilling social responsibility.
