Patent Protection and Countermeasure of Processing Technology of Chinese Herbal Pieces

本研究从中药炮制技术的学科特征出发,对中药饮片炮制技术的专利保护进行分析,即从中药具体炮制工艺出发,充分结合专利三性,分析国际竞争下炮制技术专利保护存在的问题,针对问题研究中药饮片炮制技术的保护策略。利用专利检索法分析我国中药饮片炮制技术专利申请的现状,研究我国炮制技术专利保护的现状及存在问题。从专利的新颖性、创造性和实用性的特征出发,挖掘中药饮片炮制技术专利申请的关键技术领域,针对存在问题为中药饮片炮制技术专利保护提出相关对策建议。

In this paper, the author fully considers the subject characteristics of processing technology of Chinese Herbal Pieces and analysis the patent protection from the perspective of international competition. That is to start from processing technology of Chinese Herbal Pieces and fully combined with the patent novelty, cre- ativity, practicality. The author analyzes the problems existing in the patent protection of processing technology in the international competition, then studies the protection strategy of it. By using patent search method to ana- lyze the present situation of patent application of Chinese Herbal Pieces processing technology, the author stud- ies the present situation and existing problems of the patent protection of processing technology. Based on the characteristics of novelty, creativity and practicality of patent, the paper try to mining the key technologies of patent application for processing technology of Chinese Herbal Pieces, then put forward relevant countermeasures and suggestions for the protection of the existing problems.
