劳动法律规制中就业目标与经济目标实现的理性 被引量:2

Reason of Labor Legislation on Employment Goal and Economic Target

摘要 虽不能将我国当前"经济下行"的发展现状完全归因于劳动立法,却也并非与其毫不相干。以劳动法律规制目标的理性为切入点,汲取现有立法仅着眼于劳工薪酬意义上的就业目标实现的经验教训,可洞悉疏离于劳工非薪酬意义上(尤其是精神意义上的)的就业目标及企业持续之经济目标实现的弊害。通过企业等团体组织凝聚力的保持与固化、企业等团体组织与劳工个体创新力的保持与加强、就业数量与就业质量目标以及企业经济目标与就业目标的协调等,特别是劳动者精神就业目标对企业经济目标的实现,可以使所创制的劳动法律制度在兼顾劳动者与企业利益的同时实现企业发展所需科技及创新力的落实、提高,它是"经济上行"发展的精神性制度。 Slow growth of the national economy cannot be attributed to labor legislation, but they is related to each other. We should be absorbed in the reach of rational labor law aim by tak- ing some measures so that labor law system help to promote sustained and stable and fast develop- ment of the national economy. So we should concern not only material employment aim but also moral employment goal and sustained economic target in labor legislation of china. Besides this, we should keep on and increase the collective 'cohesion and creative ability of workers, and co- ordinate the development of the different target including employment quantity goal and employ- ment quality goal and economic target, especially should pay attention to the meaning of moral em- ployment aim in the reach of economic target.
