破产重整制度新发展:引入预重整

The New Development of Bankruptcy and Reorganization System in China:Adopting the Pre-reforming System

我国《企业破产法》中规定的破产重整机制,已经不能完全满足现实中困境企业复杂多变的需要。当下有必要在继续坚持现有重整机制基础之上,引入新型困境企业拯救机制——预重整。作为对破产重整机制的改良之策,我国应该考虑在将来破产立法中对预重整制度予以构建。

The bankruptcy reorganization mechanism stipulated in the Enterprise Bankruptcy Law of China can no longer satisfy the complex and changeable needs of the enterprises in reality. Therefore, it is necessary to insist on the existing restructuring system and introduce a new type of enterprise's rescue mechanism--Pre-reforming system. As an improvement of the bankruptcy reorganization mechanism, China should consider the establishment of the pre reorganization system in the future bankruptcy legislation.
