法治政府视阈下的政务公开制度的困境与突破

The Dilemma and Breakthrough in the Openness of Government Affairs under the rule of law

政务公开作为一种进步的政治理论与实践,是社会主义民主政治的重要体现,是促进法治政府构建的强有力的动力之一,是保障公民知情权、维护社会公平的武器。目前,我国政务公开制度建设还不成熟,客观原因主要是缺乏完备的法律法规、《中华人民共和国政府信息公开条例》的本身缺陷、行政资源配置出现短板;主观原因是行政人员的素质不足、公民的参政、议政能力不够以及人们对"人治"的惯性思维认定等等。因此,在大力提倡法治政府的建设和推行依法行政的背景下,应该健全和修订相关法律法规为政务公开的实施提供依据,创建良好的行政环境为政务公开的实施提供平台,坚定依法行政减少腐败为政务公开的实施扫清障碍。

Open government system as a progressive political theory and practice, is the important embodiment of socialist democracy, and is one of the souce of power to promote the rule of law and is the weapon of the citizens to know and maintain social justice. At present, our government system construction is not mature, the objective reason mainly is the lack of perfect laws and regulations, the government in-formation disclosure ordinance, administrative allocation of resources. The Subjective reason is the insufficient administrative personnel, citi-zen participation, as well as people＇s inertial thinking of the “rule of man” , and so on. In promoting the rule of law, therefore, under the background of the government construction and the implementation of administration according to law, China should improve and revise rel-evant laws and regulations to provide the basis for the implementation of the government affairs, create the good administrative environment to provide platform for the implementation of the open government, administration according to law, and reduce corruption.
