摘要
在网络环境下,数字图书馆面临着著作权的侵权风险。在传统著作权例外适用范围狭窄,大部分著作权人误认为数字图书馆负有网络审查责任的境况下,数字图书馆建设的法律保障十分必要。我国数字图书馆适用"避风港"规则已有较为完善的法律基础、社会政策基础,在适用"避风港"规则时,数字图书馆需履行合理的注意义务以及收到著作权人合格侵权通知后的删除义务以避免侵权责任。
The digital library is facing the risk of copyright infringement under the network environment. It is quite necessary for the digital library to apply legal protection during its digitalization construction in the circumstance of narrow applicable range of traditional copyright exceptions ＆ most of the copyright owners mistaking digital library for the responsible of network censorship.On the basis of the relatively well-developed legal system and social policy,it is important for the digital library to fulfill the reasonable duty of care ＆ information deletion obligations upon receiving the qualified notification from copyright owners in order not to assume tort responsibility during its application of ＂the safe harbor＂ rule.
