清代安多藏区的法制建设与社会控制

The Law System Construction and Social Control in Amdo Region during the Qing Dynasty

随着对安多藏区国家政权建设的加强,清朝亦强化了通过法律加强对安多藏区的社会控制。这不仅表现在单行法规《番例番规》之上,还体现在相关的土官制度与藏传佛教管理制度的立法方面,将安多藏区作为单独的条目予以清晰化。这些立法既可以看作是"因俗而治"基本指导精神下法律体系的完善,也反映出清朝对安多藏区社会控制的不完整性与过渡性色彩。

Following the strengthening of state administration construction in Amdo,the Qing Dynasty also strengthened social control by building law system in this region.This was not only reflected in special enactment Fanli Fangui(《番例番规》),but also in legislation on chieftain and Buddhism management institution which took Amdo as place to implement its special clauses.These legislations could be considered as completeness of law system in the spirit of'administration following customs',meanwhile reflected the incompleteness of the Qing Dynasty's social control in Amdo region.
