司法规律是在司法运行中存在的内在的、本质的、必然的联系。司法规律与司法价值、司法制度、司法实践等关联要素之间相互影响、相互作用、相互促进。对司法规律和其关联要素的关系探讨是研究司法规律的全新视角。司法规律体现司法价值的要求,实现司法价值必须遵从司法规律,司法规律随着司法价值的发展而不断发展。司法规律指导司法制度的构建,司法制度是对司法规律的立法确认,司法制度对司法规律具有能动的反作用。司法规律来源于司法实践,对司法实践具有指导作用,司法实践是检验司法规律的重要标准。

The judicial rule reflects a kind of inherent, essential and inevitable connection existing in the process of the judicial operation. There is an interaction between the judicial rule and some relative elements such as the judicial value, the legal system and the judicial practice. It is a new perspective to research on the relationship between the judicial rule and the relative elements. The judicial rule reflects the requirements of the judicial value, directs the realization of it and develops continuously with the development of the judicial value. The judicial rule guides the construction of the legal system. At the same time, the legal system confirms the judicial rule in the form of legislation and it also has an active effect on the judicial rule. The judicial rule comes from the judicial practice, directs it and must be examined by the judicial practice.
