摘要
高等学校教师法律身份直接关系到教师与学校法律关系的定性。该法律关系性质不明确又使得司法在处理教师与高校纠纷时往往采取谨慎介入甚至消极不介入态度,这导致高校教师权利无法得到应有的救济。为保障高校教师权益、保证其职业的公益、公务性与专业性,结合当前法制环境,我国应构建公务雇员法律制度,将高校教师等提供公共服务的事业单位的工作人员纳入其中,确立高校教师公务雇员法律身份,明确教师与高校、教育行政管理部门之间权利与义务关系,进而完善各类事业单位行业规范及监管等相关配套规章制度。
The legal identification of Chinese teachers in universities and colleges has directly affected the definition of legal relationship between teachers themselves and universities, which makes the judicature take a prudent attitude towards intervening in disputes between the both parties or it is even not involved negatively in such situations. As a result, teachers' rights cannot be relieved effectively. According to the current legal environment, the legal institution of civil employee shall be established in the future, the staff of institutional organizations who provide the public services included with the aim of protecting the interests of teachers and ensuring the public welfare, official duties and specialty of their occupation. Entrenching the legal identification of civil employee of Chinese teachers in universities and colleges as well as stipulating the rights and obligations among teachers, universities and administrative department clearly shall improve the code of conduct along with relevant series of rules and regulations of various institutional organizations.
