声音商标注册问题研究

Research on the Registration of Sound Trademark

囿于声音商标受《中华人民共和国商标法》(简称《商标法》)保护时间过短,注册成功的声音商标数量尚不多,目前我国十分欠缺声音商标的审查及审理经验。为此,有必要考察各国关于声音商标注册申请与保护的做法,总结我国《商标法》赋予声音商标的意义在适用中存在的第二含义、非功能性、可描述性等问题,并分别从声音商标经营者角度和立法角度提出完善我国商标法律制度中关于声音商标注册规定的建议。

Confined to the sound by the ＂People＇s Republic of China Trademark Law＂ （＂Trademark Law＂） protection time is too short, the number of successful registered trademark is not much, China considerably lacks sound trademark examination and trial experience. Therefore, it is necessary to carry out research on the methods that other countries have applied into application for registration and protection of sound trademark, to summarize the exiting issues in practices on second meaning, trademark function as well as description after it acquired protection by Trademark Law of China, and to improve legislation of sound mark registration in trademark legal system of China.
