摘要
形成调整多式联运的运输规则是"一带一路"战略的合作重点之一,对此《鹿特丹规则》具有重要的借鉴意义。《鹿特丹规则》中对多式联运的规定,第26条及第82条,从条文本身来看,不仅有损于规则的统一适用,而且从司法实践的角度,会给缔约国带来困难或者并没有多大意义。调整"一带一路"战略下海运加其他运输方式多式联运的运输规则需要克服前述问题。而对《鹿特丹规则》第26条及第82条缺陷成因的分析,也为调整"一带一路"战略下其他类型多式联运的运输规则提供了借鉴。
One of the pivotsof cooperation under "One Belt One Road" Strategy is to develop the rules on muhimodal transport, for which the Rotterdam Rules can be used as important reference. The provisions of Rotterdam Rules towards multimodal transport are, article 26 and article 82, not only harmful for the uni- form application of Rotterdam Rules, but also hard to be applied in practice or meaningless. These short- comings should be conqueredin the rules on muhimodal transport constituted by sea transport and other mode of transport under "One Belt One Road" Strategy, furthermore, the analysis of the mentioned short- comings also provideslessons to the rules on other types muhimodal transport under "One Belt One Road" Strategy.
