政府采购合同分包供应商选择与激励约束机制研究

A Study of Subcontracting Supplier Selection System and Inspiration-restraint Mechanism in Government Procurement Contract

中国当前政府采购法律体系中虽然规定了政府采购合同可由中标供应商实施合同分包履行制度,但因缺乏完整的制度结构和细致的制度操作流程,导致实践中其应有功能价值无法完全实现。本文对政府采购合同项目中分包供应商选择机制与约束激励机制展开研究。通过分析论证了采用两阶段指标评价方法可选择出最优的战略分包供应商,并能与总包供应商形成合作伙伴关系,这对中小企业参加政府采购分包合同项目具有重要启示。同时,从建立政府采购分包合同的伙伴型合作模式目的出发,除了要建立抑制恶性竞争或平衡良性竞争的约束机制,旨在促进信任和维护伙伴关系的激励机制也同样重要。

Chinese government procurement legal system stipulates that the government procurement contract can be carried out by the bid supplier to implement the contract subcontract system. Due to the lack of complete system structure and detailed system operation process in practice, the value of subcontract system function can＇ t be achieved. This paper studies the subcontract selection system and inspiration - restraint mechanism in government procurement contract. It is proved that the optimal strategy subcontracting supplier can be selected through the two - stage index evaluation method, and it can form a pagnership with the General Contractor, which has important revelation for the small and medium -sized enterprises to participate in the government procurement subcontract project. In order to establish a partnership model for government procurement subcontracts, in addition to establishing a restraining mechanism to curb vicious competition or balance benign competition, the inspiration mechanism to promote trust and maintain partnerships are equally important.
