言分析法学传统之荦荦大者,不外乎法学纯粹的使命、规范效力的取得和对待事实命题的态度等几项,然而自奥斯丁以来近两个世纪,分析法学就这些基本问题的看法在与相关法学阵营的论辩与交锋中发生着激烈的嬗变。分析法学究竟有没有恪守自己的传统?它到底是被其他法学阵营所吞并抑或是大家一起融入了综合法学的洪流?通过对道德命题、效力命题、事实命题三种诘问的回应,我们将得一概览。

The main problems of efficacy and the attitude towards analytical jurisprudence is the pure mission of law, the acquisition of law factual proposition. But for almost two centuries since Austin, the view- point about the key questions of analytical jurisprudence has changed intensely in the debate and confronta- tion with the relevant schools of law. Did the analytical jurisprudence follow its tradition？ Is it swallowed by other schools of law or merged into the integrated law？ Through the response of the moral proposition, the validity proposition and the fact proposition, we will have an overview.
