Innovation and Development of Legislation of Police Power in Important Strategic Opportunity Period

警察权存在的正当依据在于维护社会治安,因此,有必要从宪法高度明确警察权的功能,建立警察权法制化的评估机制和执法责任制,采用一定的法律原则对警察权进行规制。充分利用和进一步完善执法安全国际合作机制,保障"一带一路"发展战略的顺利进行。"互联网+"背景下,衍生出的涉警网络舆情问题,使得警察群体应对乏力,导致舆情制度不完善、思想认识不到位。应制定《社会治安综合治理法》,将治安社会治理逐年常态化,形成强有力的组织体系、执行体系、保障体系和监督体系。全面深化公安工作改革,要正确认识刑警除罪权、警察刑事证据的收集和警察出庭作证等相关问题。

Police Power exists in maintaining social orders, so it is necessary to make the functions of police power clear from the point of Constitution, to set up the assessment and law enforcement responsibility mechanism, and to regulate with legal principles. We should take advantage of and improve international cooperation in law enforce- ment security to guarantee One Belt One Road Initiative. In ＂internet＋＂ era, some related problems as internet public opinions concerning police that can not be coped with effectively. Comprehensive Social Governance Act should be formulated to normalize social governance, and to make powerful systems involving organization, execu- tion, guarantee, and supervision. It is required to deepen public security reform comprehensively, and to understand such problems correctly as the police right of decriminalization, police criminal evidence collection, and police testi- fying in court.
