我国矿业权法律性质研究综述

Research Review on the Legal Nature of China's Mineral Rights

矿业权的法律性质是近年来环境法学界、民法学界,甚至宪法与行政法学界研究中的一个热点问题。其研究范畴主要包括矿业权的法域归属和矿业权的财产属性两大部分,研究呈现出显著的多元性、现实性和物权化的特点,但也存在着研究思路的碎片化,重概念分析、轻实践分析,研究思路过于单一,大多数的研究集中于"物权化"等不足。借鉴域内外成熟的研究成果,结合中国实际,突破实践困境、开拓研究思路、创新研究方法,建立健全我国矿产资源产权制度,是今后我国矿业权研究创新发展的努力方向。

In recent years, the legal nature of mineral rights has become a frequently debated topic in the fields of environmental law, civil law, constitutional law and administrative law. There are mainly two perspectives of such research, namely the scope of law attribution and legal attribute of the mineral rights. The studies are of the characteristics of diversity and reality, and mainly focus on the property studies. However, there are also some limitations in the current research, to name just a few： the of practical analysis, focusing on concepts, concentrating most of the fragmentation of research ideas, ignorance research on＂ property＂ , etc. This article holds that the future direction of mineral rights research innovation should be referring to overseas research achievements, taking into account the Chinese realities, resolving the current dilemma, expanding research ideas, and making innovations in research methods so as to establish and improve China＇ s mineral resources property rights institution.
