云南少数民族民间文学类非物质文化遗产知识产权保护研究

On Intellectual Property Protection of Intangible Cultural Heritage of Folk Literature of Yunnan Ethnic Minorities

云南少数民族民间文学类非物质文化遗产资源丰富且商业价值日益凸显,在保护、开发和利用中面临着许多民事权益问题。因此,除行政保护外,有必要引入知识产权制度对其进行保护。针对目前云南少数民族民间文学知识产权保护存在的问题,文章提出完善知识产权保护法制体系、普及知识产权教育、制定知识产权保护战略,采取公法、私法、非政府组织相互促进的保护模式,加强云南少数民族民间文学类非物质文化遗产的知识产权保护。

The intangible cultural heritage of folk literature of Yunnan ethnic minorities is rich and abundant, and its commercial value has become increasingly prominent. Accordingly, the civil rights and interests problems come along with its protecting, developing and using. In addition to administrative protection, it is necessary to use intellectual property system to protect it. In the light of the problems in folk literature of Yunnan ethnic minorities, a perfect legal system, popularizing intellectual property education and establishing strategies of intellectual property protection are suggested. Taking public law, private law and NGO to promote mutual protection model, intellectual property protection of intangible cultural heritage of folk literature of ethnic minorities in Yunnan will be enhanced.
