我国香港地区股权众筹监管研究——以新加坡监管改制为借镜

The Research on the Regulation on Equity-based Crowdfunding in Hong Kong——Learning from Regulatory Reform in Singapore

我国香港地区至今并未针对股权众筹进行立法上的管制。本文经过审视股权众筹的本质和当前香港证券公开发行规制,指出尽管仍旧存在法律上的盲点,在香港当前的证券监管并不会对股权众筹形成严重阻碍,但无法促进股权众筹充分发挥其应有作用。

Up to now, there has not been the legal regulation on equity-based crowdfunding in Hong Kong. The paper reviews the essence of equity-based crowdfunding and regulations on public offering securities in Hong Kong, and points out that although there exists the legal absence, the current securities supervision will not severely hamper the equity-based crowdfunding in Hong Kong, but can5 t promote the equity-based crowdfunding to give full play to its due role.
