患者自主决定权与医生医疗干涉权的博弈研究

The Study on the Game between Patient's Right of Self-Determination and Medical Interference Right

近年来,医患关系愈来愈紧张,其中患者自主决定权与医生医疗干涉权的博弈是其重要原因之一。这两种权利的博弈主要表现为自主权的膨胀和干涉权的滥用,继而引发了严重的社会问题和伦理问题。因此,根据我国现有的法律、处理机构等的不足,结合国外对两权博弈的处理,建议通过完善法律对特殊情形的界定、建立第三方机构、创建机制解决两种权利的博弈,兼顾医患双方的权利,改善医患关系。

In recent years,the relationship between doctor and patient has became more and more strained,one of its reasons is the game between patient＇s right of self-determination and medical interference right.It mainly displays in the expansion of patient＇s right and the abuse of doctor＇s right,which leads to serious problems.Thus due to the lack of law and institutions in our country and foreign experience,the relationship can be improved by revising the law,establishing the third-party organization and creating mechanisms.
