摘要
著作权绝对主义的实质是将著作权视为有期限的无限制的财产权。这使得著作权的推理与保护规则倾向于将作品的全部剩余利益归属于著作权人,也使得限制体系逐渐膨胀。这种理念建立在将著作权视为对抽象物的支配权与绝对权的制度基础上,并获得了财产理论的支持。其经济根源在于产业组织者意欲通过财产权让与获得市场利益。绝对主义理念过度强调著作权的自然权利属性,将不利于文学艺术领域的创新与新兴产业的发展。
The supremacism of copyright is that copyright is regarded as an unlimited property right with a period of time under in essence. It makes the rules on inference and protection of copyright tend to attribute all the remaining interests of works to copyright owners and renders the expanding systems of limitation. This concept is based on the system that the right is an absolute and controlling right to Abstract Matter, supported by property theory. The economic root is that the industry organizers intend to obtain market benefits through the transfer of property rights. The excessive emphasis on copyright as natural right is not conducive to the creation in the field of literature and the development of new industries.
