我国MOOC发展中的版权问题研究

MOOC在我国发展迅猛,但也出现了诸多问题。其中MOOC版权问题已成为其发展瓶颈。MOOC具有可版权性。由于MOOC凭籍互联网等多媒体工具进行传播,导致其制作和运行除了涉及教师、学生、院校三方之外还涉及MOOC平台提供方和原始版权所有者等诸多利益相关者,且各利益相关者相互关联,因此,MOOC版权问题十分复杂。MOOC版权具有版权归属复杂、非营利性属性的加入、授权成本大的特征。MOOC版权归属涉及院校与教师之间,教师和原始版权所有者之间,MOOC平台与用户生成内容之间的版权归属。我们可以通过职务作品的界定,合理使用原则的使用和UGC(用户生成内容)的版权归属等来解决其相关问题。

MOOC develops fast in China but many problems also emerge. The copyright problem of MOOC has become the development bottleneck. MOOC is copyrightable. MOOC is spread by Internet and other multimedia, as a result, the production and running of MOOC involve MOOC platform provider and original copyright owner besides teachers, students, schools, and the stakeholders are mutually connected. Therefore, MOOC copyright has complex ownership, non-profit attribute and high authorization cost. The ownership of MOOC copyright involves between school and teacher, between teacher and original copyright owner, between MOOC platform and user generated content. We can solve relevant problem through definition of service works, use of rational use principle and UGC （user generated content） copyright ownership.
