民事诉讼证据收集制度的演进与发展——兼评环境公益诉讼证明困境的克服

Evolution and Construction of the Evidence Collection System in Civil Procedure——Comment on the overcoming of the proof dilemma of environmental public welfare litigation

证据收集制度是影响民事诉讼能否有效运行的关键因素。我国民事诉讼证据收集制度不能充分保障当事人的证明权和满足司法实践的需求,加之公益诉讼制度的建立,改革和完善证据收集制度更具紧迫性。我国未来证据收集制度的完善,应树立证据收集模式类型化、证据协力义务和收集必要证据原则,规范文书提出命令及法院依职权调查收集证据等具体证据收集制度立法。

Evidence collection system is the key factor to affect the effective operation of civil procedure. Because China＇s civil litigation evidence collection system can not fully protect the rights of the parties and meet the needs of judicial practice, combined with the establishment of the environmental public welfare litigation, it is necessary to reform and improve the evidence collection system. The establishment of the evidence collection system in the future should abide by the principles of the type of litigation, the evidence assistance duty and the necessary evidence collection, ehance the legislation related such as order for production of a document and the collection of evidences by courts according to their official power.
