三权分置格局下农村土地流转政府监管刍议

On the Government Supervision of Rural Land Circulation under the Pattern of Separation of the Three Powers

在三权分置格局下,农村土地流转规模越来越大,土地流转水平越来越高,但在流转过程中也乱象频出。主要问题包括三权分置格局下制度出现漏洞、基层政府失当行为阻碍土地流转、市场监管不力等,解决这一系列问题,需要政府对土地市场进行监管。具体而言,政府应当尽快开展土地确权登记工作,健全土地流转合同签订和登记备案制度,加强土地政策宣传;政府应当搭建公平、公正的土地流转信息平台,建立土地价格标准合理定价制度,做好土地流转档案管理工作;政府应当妥善处理土地流转纠纷,以确保农村土地流转高效、有序。

Under the new situation of separation of the three powers,the scale of rural land circulation becomes larger and larger,the level becomes more and more high,and various problems occur.The main problems such as system detect under property rights of separation rights division,land circulation hindering due to government misconduct and lack of market regulation etc.These series problems need to be solved urgently.The govermneut needs to supervise land market. Government supervision include pre-supervision,course- supervision and post-supervision.Pre-supervision：the govermnent should strengthen the land approval registration,perfecting the land eireulation contract verification and registration of the record system,strengthening the land policy propaganda etc.Course-supervision：the government shoul＇d set up the land circulation information platform for fairness and justice,set up the standard land price reasonable pricing and make a good management of land c, irculation file.Post-supervision：the government should provide good service for both sides for land circulation,handle the dispute actively and properly for land circulation,in order to reduce land disputes,ensure that rural land circulation operation efficiently and orderly.
