行政法平衡理论新探

A New Exploration on the Balance Theory of Administrative Law

作为现代行政法理论基础之代表的平衡理论,经过二十余年的演进,已经形成了较为成熟的理论框架和较为完备的学说体系。但是,正在兴起的公共治理和不断革新的行政实践,彻底改变了平衡理论创立之初的制度背景,使其在主体、内容、目标、结构等环节都面临着新的理论张力。公法仍在变迁,平衡理论亦应当与时俱进不断发展。因此,应建立多元行政主体参与机制,推进合法性和最佳性的二维结构互动,关注行政行为与行政环境的融合,以真正实现"合理诠释历史、有效回应现实、逻辑上完整自洽"的理论革新目标。

As a representative of theoretical basis of modern administrative law,balance theory has formed a more mature theoretical framework and a more complete theory of the system after more than twenty years of evolution.However,the emerging public governance and the continuous innovation of administrative practice has completely changed the system background of the establishment of the balance theory,which make it face new challenges in the subject,content,objec- tive ,structure and other aspects.Public law is still changing and balance theory should keep pace with the times.The ba- sic direetion of theoretical reform is：highlight participation mechanism of muhiple administrative subjects,lay equal stress on subjective administrative law and objective administrative law,focus on two dimensional structure interaction of legiti- macy and optimality,focus on the integration of administrative behavior and administrative environment.Truly achieve the theoretical innovation about rational interpretation of history, effective response to the reality and the logic of a complete self consistent.
