浅析非专利实施主体对专利运营的影响

The Effect of NPE on Patent Application

随着我国自主创新能力不断增强,专利数量快速增长,如何使专利能够有效实施成为亟待解决的问题。本文以美国曾对专利运营发挥重要作用的非专利实施主体(NPE)为对象,分析了其基本特征和类型,同时针对我国目前专利运营中存在的专利运营模式单一、专利交易市场不成熟等问题进行了阐述,在结合我国专利运营实际情况的基础上,重点分析非专利实施主体对于我国专利运营的影响,并以高校为例阐述了非专利实施主体对我国专利运营的借鉴价值。

With the increasing independent of China＇s innovation capacity, the number of patents increased rapidly, how to make the patent effectively implemented become an urgent problem to be solved.This paper analyzes the basic characteristics and types of non-patent implementing entity（NPE）, which played an important role in patent application in the United States.Meanwhile,aiming at the problems of the patent application mode existing in our country, such as the single patent application mode, the immaturity of the patent trading market and so on.Based on the actual situation of China＇s patent application, the paper analyzes the impact of the NPE on the patent application in China and illustrates the reference value of NPE to the patent application in China.
