广东省建设项目闲置使用林地现状及其处置对策

Status and Countermeasures of the Idle Forestland Requisitioned and Occupied by Construction Projects in Guangdong

建设项目使用林地审核审批手续是法定责任和要求,用地单位及时用地,是贯彻落实林地定额管理和用途管制的客观要求,也是促进社会经济发展的重要途径。文章通过分析广东省建设项目闲置使用林地的现状,指出问题。分析原因认为,项目没有取得建设用地指标,项目不符合规划要求,用地单位没有落实建设资金、有意囤地、没有落实用地补偿等因素是造成林地闲置的主要原因。提出严把项目使用林地审核关,及时报告使用林地进展情况,出台闲置林地处置办法等解决闲置使用林地问题的对策,以促进依法及时、节约、集约使用林地。

Formalities of examination and approval for construction projects using forestland are the legal responsibility and requirements. Timely use of land by the construction party, which is the objective re- quirement to implement forestland quota management and forestland use control, plays an important role in promoting social and economic development. By analyzing the status of the Idle forestland requisitioned and occupied by construction projects in Guangdong, this paper pointed out the main reasons of the prob- lem that the projects didn＇t obtained the index to use construction land or didn＇t conform to the require- ments of the planning or the construction party didn＇t carry out the construction funds and the land com- pensation but reserved land illegally. This paper also put forward suggestions of the strict examination on forestland use, the timely report about the progress of forestland use and the measures of managing the i- dle forestland to promote timely, saving and intensive use of forestland in accordance with the law.
