论台湾地区判决先例的查明及适用

On the Determination and Application of Precedent in Taiwan

台湾地区奉行成文法系传统,制定法是台湾地区民事法律的主要渊源。20世纪初我国所建立的判决先例制度在台湾地区施行至今,现存的民事判例经过实践肯定,亦构成台湾地区民事法律的重要渊源。查明和适用台湾地区判决先例,对于在涉台审判中正确适用台湾地区民事法律不可或缺。台湾地区判决先例的查明须依法定方法,综合运用司法互助、台湾地区权威出版物和互联网数据库等渠道,并注意所查明判决先例的效力。适用台湾地区判决先例,应警惕"政治解释",遵循台湾地区判决先例适用的法律方法。

Taiwan has consistently pursued the tradition of written law system and statute law has become the main source of civil law. The precedent system established in the mainland in the early twenty century has been so far implemented in Tai- wan and the existing civil cases affirmed through practice have also constituted an important source of civil law in Taiwan. Tile ascertainment and application of precedent of Taiwan is indispensable to Taiwan-related trial. On the other hand, the approa- ches to the determination of Taiwan precedent should be taken by law, through the comprehensive use of legal assistance and other channels including authoritative publications and Internet databases, and at the same time, attention should be paid to the effectiveness of ascertained precedents. In addition, we should be also wary of ＂political interpretation＂ and follow Taiwan ap- plicable law methods in the application of precedent.
