虚拟财产流转法律问题研究

Research on Legal Issues of Virtual Property Transfer

针对虚拟财产流转中的法律问题,在对虚拟财产的法律属性进行判断的前提下,对虚拟财产的概念进行了界定,并对其进行了分类,分析各类虚拟财产可能存在的流转障碍。同时,通过归纳出虚拟财产特殊的占有方式及可流转虚拟财产的转让、继承等流转方式,提出我国应当通过完善网络虚拟财产交易立法及加强对虚拟财产的交易市场监管等措施来完善虚拟财产流转机制。

Aiming at the legal issues of virtual property transfer, this paper gives a definition to the con-cept of virtual property under the premise that the legal attributes of virtual property was being judged. After-wards it classifies the virtual property and analyzes the transfer obstacle. Meanwhile, by conclusion of the special ways to possess a virtual property, the ways to transact and inherit the virtual property which can be transferred, this paper suggests that our country should complete the virtual property transfer system by means of improving network virtual property transactions legislation and strengthening the regulation of virtual property trading market.
