我国现阶段的案例指导不同于西方国家的判例,也有别于新中国成立以来法院运用案例指导司法实践的方式,它是在承袭历史传统的基础之上,面对社会转型适时做出的理性回应。从契合时代的需求出发,现阶段指导性案例的功能应当包括:微观层面,通过指导解决具体个案统一法律适用;中观层面,能够促进法律体系自身的发展;宏观层面,沟通司法与社会,完善社会管理职能。三个层面相互依存、相互影响。

The case guidance of our country is different from the precedent of western countries, and also different from the method of using case to guide the judicial practice since founding of the nation.
