上海自贸区负面清单管理模式向全国复制推广的难点及对策研究——以安徽省为例

The Difficulties and Countermeasures of the Negative List Management Model of Shanghai FTA to the Whole Country—— Taking Anhui Province as an example

在2018年起全国实施统一的市场准入负面清单制度的大背景下,以安徽省为研究主体,结合上海自贸区的实施现状,对负面清单管理模式向全国复制推广的难点进行分析。发现:首先,政府转型存在不适应之症,且负面清单与现行政策法规之间存在冲突;其次,外资监管体系不完善,难以界定开放与保护边界;最后,制度设计与执行存在偏差。在此基础上,对在全国复制推广负面清单管理模式提出政策建议以供参考。

Under since 2018, com the background of the implementation of the unified market access negative list system bining the implementation status of Shanghai Free Trade Area, this paper takes Anhui Province as the research subject to analyze the difficulties of replication and promotion of the negative list management model to the whole country. The study shows below. Firstly, there is no adaptation of the government in the transition, and there is a conflict between the negative list and the existing policies and regulations. Secondly, under the imperfect supervision system of foreign capital, how to correctly define the boundaries of opening and protection is important. Last but not least, there is deviation between the design and implementation of the negative list. Based on the conclusions, the paper puts forward some policy suggestions with replication and promotion of the negative list management model.
