大数据监管的政府责任——以隐私权保护为中心

Government Responsibilities on Big Data Regulation:From the Perspective of Privacy Protection

大数据技术引发了经济模式的深度变革,也带来了对个人隐私前所未有的挑战。在实现技术革新的同时如何规范个人信息使用,是大数据监管的首要目标。鉴于目前我国大数据监管面临的主要困难,当前有效的解决路径是着力加强政府监管责任。国家拥有表达自由、信息自由、公众知情及隐私等基本权利的规制权限,加强制度的有效供给是义务所在。市场监管是政府经济职能之一,应当发挥监管职能,改革监管模式、优化执法技术,实现有效规制。在这一过程中既要释放经济发展的创造力,又要保护好公民隐私,应对技术变革。

Big data technology has led to profound changes in the economic model, and unprecedented challenges to personal privacy. It is the primary goal of big data regulation to control the use of personal information in the pursuit of technological innovation. By analyzing the current difficulties in large-scale data regulation in China, the thesis argues that efforts should be made to strengthen the government＇s regulatory responsibilities. The state wields the legislative authority over the basic rights of freedom of expression, freedom of information, public knowledge and privacy. So it is duty-bound to strengthen the effective systematic supply. In exercising market supervision, the government should give full play to its supervisory function, reform its supervision mode and optimize its law enforcement techniques so as to achieve effective regulation. In this process, the creativity of economic development should be released and the privacy of citizens be protected to cope with technological changes.
