摘要
为规范和引导在华境外非政府组织健康有序发展,保障其权益,促进交流与合作,我国政府对在华境外非政府组织实施法治化监管。改革开放以来,在华境外非政府组织的监管经历了放任发展、探索监管和法治化监管阶段。对在华境外非政府组织法治化监管,包含主体法定化、行为法治化和效益评估法治化等基本内容。当前,实现在华境外非政府组织的法治化监管仍面临着诸多困境,通过完善分类登记备案制度、构建多层次行为监管机制、开展独立的效益评估和建立完备的信息披露机制,有利于政府实现监管目标。
In order to regulate and guide the healthy and orderly development of Overseas NGOs in China, we should protect their rights and interests and promote exchanges and cooperation. Since the reform and opening up, the government of China has experienced the laissez faire, regulatory and legal supervision. Through the legalization of the main body, the behavior legalization and the effectiveness evaluation legalization, the legalized supervision of Overseas NGOs can be turned into reality in China. At present, the implementation of legal supervision on foreign NGOs in China is facing a lot of difficulties, and needs the government to improve the classification system of registration, construct a supervision mechanism for multi-level behaviors, carry out the independent evaluation and establish a perfect information disclosure system, in order to achieve regulatory objectives.
