摘要
本文对互联网金融消费者权益保护的特殊性进行分析,认为互联网金融消费者保护存在着消费者认定难,互联网高链接性带来利益集团化,适当性原则适用特殊,信息安全及数据所有权、隐私保护等问题凸显,以及传播快速带来的纠错成本高等特殊性。中国在互联网金融消费者保护方面存在着消费者界定不清、电子数据保存不规范、数据所有权不清晰、适当性原则使用缺乏规则、个人信用资产保护不力等问题,对此,本文提出正确界定互联网金融消费者、出台专门数据相关法律法规、以金融顾问弥补互联网金融消费者教育之不足、建立快捷高效的互联网金融纠纷处理机制、引入冷静期制度等政策建议。
This paper discusses the internet finance consumers' right protection. There are some problems in the interuet financial consumer protection system, e. g. the definition of the consumer in view of internet finance, interest group through the interuet, application of the principle of qualified investors, information security and data ownership, privacy protection issues, and high cost of error correction because of fast spread. In China, there are some special problems about interuet financial consumers' rights protection, such as the absence of definition about internet financial consumers, the lack of rules of electronic data ownership system and personal credit asset protection system, the shortage of the principle of qualified investors. This paper puts forward some policy suggestions such as correctly defining internet financial consumers, introducing relevant laws and regulations on special data, promoting the financial advisers system, strengthening internet financial consumer education, establishing the efficient online dispute resolution mechanism, as well as applying the cooling-off period system in internet finance.
