我国残疾人社会保障研究——基于平等权的权利维度

A Study of Special Security for the Disabled in China——From the Perspective of Equality

残疾人这一群体自古有之,随着人权事业的不断发展,残疾人的社会保障问题受到了越来越多的关注,人们不再"宿命论"式的看待残疾的发生,而更多的将社会因素考虑其中,强调社会应当对此肩负起更多的责任。然而社会保障资源是有限的,必须以合理公正的方式进行有效分配才能收获最大的社会效益,公正并不意味着人人都一样的形式平等,而应当是差别对待有差别的人的实质平等。完善中国残疾人社会保障制度需要从以上平等观的视角出发,分析残疾人社会保障的实然状态和应然状态,探索从形式平等向实质平等推进的关键因素,继而制订改进当前残疾人社会保障方案的具体措施。

From ancient times the disabled existed in society.With the development of human rights,the social security of the disaled has gained more and more attention.People don＇t regard disability as a personal misfortune in a fatalistic view,social factors are considered in new concept of the disabled and society must be responsible for it.However,the limited resources of social security is still the reality of contemporary society,and it is necessary to allocate the limited resources of social security in a fair way to achieve maximum social benefits.Justice doesn＇t not mean formal equality but substantial equality means different treatment to different people.Under the perspective of equality,we need to study reality state and ought-to-be state of the social security of the disabled,explore the key factor from formal equality to essential equality and provide some definite steps to improve the social security of the disabled.
