论公民法律素质的基本要素及其提升路径

On the Basic Elements and Improving Paths of Citizens' Legal Quality

法律的权威源自人民的内心拥护和真诚信仰,人民是全面推进依法治国、构建法治社会的主体和力量源泉,公民法律素质的高低在很大程度上决定了法治中国建设的成败。从现实层面看,我国公民法律素质与法治社会的要求还存在较大差距,"信访不信法""信权不信法"等现象时有发生,"大闹大解决,小闹小解决,不闹不解决"的思维普遍存在,因此,全面推进依法治国的民众基础还有待进一步夯实。公民法律素质的提升应当围绕法律认同、法律信任、法律敬畏、法律践行能力四个方面的基本要素展开。法律认同是法律素质提升的前提,法律信任是法律素质提升的精神动力,法律敬畏是法律素质提升的核心,法律践行能力是法律素质提升的落脚点。

The authority of the law is derived from the inner support and sincere faith of the people. The people are the main body and the source of power for comprehensively promoting the rule of law and building a society ruled by law. The level of the citizens, le-gal quality to a large extent deternines the success or failure of the rule of law in China. From a realistic perspective,there is still a big gap between the citizens＇ legal quality in our country and the requirements of the society ruled by law. That people are more inclined to appealing to the higher authorities for help than believing in law and people are more inclined to appealing to the power for help than believing in law is a frequent occurrence and the thinking that big wrangle with government will lead to a good ending ; gentle argument will bring a good solution; but if no miff,there will be no result is very common,so the popular foundation of comprehensively promo-ting the rule of law still needs to be further reinforced. The promotion of citizens＇ legal quality should focus on four basic elements,they are legal recognition,legal trust,legal reverence,and legal practice ability. Legal recognition is the prerequisite for the improvement of legal quality, and legal trust is the spiritual motive force of the improvement of legal quality, and legal reverence is the core of legal quality improvement, and the ability of legal practice is the foothold of legal quality improvement.
