国务院已经正式启动了《医疗事故处理条例》的修订工作,新法名称暂定为《医疗纠纷预防与处理条例》。从2002年《医疗事故处理条例》的修订至今,我们并没有针对医患关系想出根本性解决方案。笔者认为中国医患关系的问题实际上是医院管理模式与医疗服务模式滞后带来的症状,所以本文希望谈谈对新法可能涉及的一些关键问题的思考和立法建议,寄希望于通过立法推动中国医院管理模式与医学服务模式的转型。
