从北仲的一个典型国际调解案看中国商事调解制度的特点

本文首先简单总结了作者本人与美国著名仲裁员SallyHarpole女士共同在北京市仲裁委员会管理下独立进行的一件成功的国际调解案的经过和经验。阐述了北京仲裁委员会有效的国际组织能力；深入地分析了在全球化条件下境外商事调解方式与中国调解制度的异同及其融合点；指出了在商事调解领域内中外双方互相影响、相互推动和互相借鉴的必要性和途径。

This paper begins with a brief summary of a successful international mediation process organized by me and Ms. SallyHarpole, a well-known arbitrator of United States, in Beijing Arbitration Commis- sion. This paper expounds the effective international organization capability of Beijing Arbitration Commission. This paper analyzes the similarities and differences of foreign commercial mediation and Chinese mediation system under the condition of Globalization. It points out the necessity and way of mutual influence, mutual promotion and mutual reference between Chinese and foreign parties in the field of commercial mediation.
