“宪法学”课程教学改革探讨 被引量:2

A Preliminary Research of Teaching Reformation of the Course “Constitutional Law”

摘要 宪法是国家的根本大法,高校法学教育中的"宪法学"课程教学应积极作出回应。目前,各高校教师对宪法学教材选择的随意性较大,在教学内容和教学方法上多采用以司法考试为视角或是单纯的理论视角。"宪法学"课程教学应是在理论和实践教学层面做到与"宪法实施"这一目标积极互动,以呼应当前宪法学的学科需求。针对"宪法学"课程的特点,教学中对其学科应有准确定位,分析并处理好宪法学中政治性和规范性的关系;在教学内容的设计上应处理好宪法理论和宪法事例与宪法实施之间的关系,改变传统理论教学,增加宪法案例教学、实践教学,提升"宪法学"课程教学的实效性。 Constitution is the fundamental law in one country,consequently Constitution teaching should actively respond in colleges and universities' legal education.At present,the choice of Constitutional teaching materials in college teachers is extremely arbitrary and the teaching contents and methods focus on judicial examination or simply a theoretical perspective.In fact,the teaching of Constitutional Law should interact with the object of"constitutional implementation"in the theory and practice teaching level so as to meet the demand of the current constitution discipline.Specifically,first teaching should have an accurate positioning of the discipline according to the characteristics of the course"Constitutional Law"and deal properly with the relationship between politics and normalization in constitution discipline.Second,the design of teaching content reasonably should distribute the proportion of constitutional theory,the constitutional example and the implementation of the constitution.It should change traditional theoretical teaching,and increase constitutional case teaching and experiment teaching,improve the teaching effective of the course"Constitutional Jurisprudence".
