韶关市科学立法的困境及对策研究——以《韶关市制定地方性法规条例》为视角

On the Dilemma and Countermeasures of Scientific Legislation in Shaoguan:From the Perspective of the Promulgation of Local Regulations and Ordinances in Shaoguan

地方立法是良法善治的前提和基础。实践中,地方立法缺乏一定的地方特色,重复立法现象较为严重,存在地方保护主义、部门保护主义及立法碎片化等倾向,从而影响了地方立法的质量。《韶关市制定地方性法规条例》的颁布是韶关市法治建设的里程碑。因此,要准确定位,地方立法彰显韶关特色;集思广益,创造性地运用立法协商制度;强化地方立法的专业性,提高韶关的立法技术和立法质量,为全面建成小康韶关奠定坚实的法治基础。

Local legislation is the premise and foundation of good law and good governance. In practice, local legislation has been substantially inclined to some peculiarities, such as lack of local characteristics, repeated legislation, local or sector protectionism as well as legislation fragmentation etc., which phenomenon has seriously affected the quality of local legislation. The Promulgation of Local Regulations and Ordinances in Shaoguan has symbolized the milestone of the construction of rule of law in Shaoguan. Therefore, we are supposed to set up the right goal and highlight Shaoguan characteristics in local legislation, draw on collective wisdom and absorb all useful ideas, take full advantage of legislative consultation system, strengthen the specialization in local legislation, improve legislative technique, which aims to improve the quality of local legislation and lay a solid foundation for the rule of law in the process of the comprehensive construction of well-off Shaoguan.
