环境司法专门化的构成要素与实现路径

The Components and Realization Way of Environmental Judicial Specialization

环境司法专门化是我国环境司法改革的积极尝试,厘清构成要素是界定环境司法专门化的前提与基础。构成要素包含专门化的审判理念和实施机制,实施机制包括专门化的审判机构、受案范围、诉讼规则、执行规则。针对实践中存在的机构设立不规范、受案范围不明确、诉讼规则不完善、执行方式效果差等问题,应将公益诉讼作为环境司法改革的中心工作,从制度设计和规范指引两方面着力构建环境司法专门化的实现路径,同时还应积极探索高效运行的保障机制。

Environmental justice specialization is the attempt of judicial reform in China. Clarifying its components is the premise and foundation to define environmental justice specializa- tion. The components including specialized trial idea and implementation mechanism, the imple- mentation mechanism including specialized judicial institutions, scope of accepting cases, the rules of litigation, the executive mode. In view of the existing difficult in the practice, such as nonstandard institutional establishment, ambiguous scope of accepting cases, imperfect procedure rules, poor implementation effect, environmental public interest litigation should be the center of the judicial reform work, from two aspects of system, design and specification guidelines to build the realization of environmental justice specialization path. At the same time, we should actively explore the construction of efficient operational security mechanism.
