摘要
本体论作为西方思想的基石,对哲学的影响深远,作为同源的法哲学,本体论对法律思想的影响不容小觑。但在我国,学界对法律本体的探讨却久被忽视了。首先,笔者从语源考查了"本体"的谱系。其次,对法律本体的繁杂意义及价值展开阐述。再次,笔者阐释了自然法及法律实证主义的历史脉络,并对其进行比较论述,从而进一步对法的本体展开探讨。最后,通过对自然法和实证主义的再认识,笔者力图从自然法的视角提出我国在法律本体上应采取的进路。
The system of ontology, the cornerstone of Western thoughts, has deeply influenced philosophy, and exerted great im- pact on legal philosophy as well. But the legal ontology has long been neglected by researchers in China. To start with, this paper reviews some basic concepts involved, including the pedigree of ontology from linguistics and etymology, the meaning and value of legal ontology, and the historical line of natural law and its theory. Then, it explores legal ontology by comparing natural law and legal positivism. Finally, the author proposes the ontological approach to law in China from from the perspective of natural law.
