摘要
微小违法行为是社会均衡状态下大量发生的行为,相比于犯罪或重大违法行为,其发生概率大并且纠正难度大,本文试图从正义观角度认识并解释微小违法行为。基于常识和传统法律文化基因所集聚而成的正义观支配着人们的守法和违法,而正义观的局限性致使人们内心衍生一种违法的正当性观念,在此观念的确信之下,人们做出的微小违法行为极易演变为生活习惯,要纠正这种习惯化的违法行为,本文讨论了法律道德主义的重罚化和依靠时空变迁的正义观的扩大化两种路径。
Minor violations is a kind of behavior large in its possibility of occurrence and difficult to correct in the state of social equilibrium, compared with crime or major violations. This paper attempts to explore and interpret minor violations from the per- spective of justice. The sense of justice based on the common sense and traditional legal culture genes dominates people's law - abiding or breaking acts. However, the limitations of justice make people derive a sense of legitimacy in the heart, which are prone to evolve into the habit of minor violations. To correct this habitualized illegal behavior, we propose two ways, heavy pun- ishment of legal moralism and expansion of the concept of justice, which depends on time and space change.
