依法行政视角下推进我国体育社会组织的发展

Promoting the Development of Sport Social Organizations from the Perspective of Law-based Administration

依法行政是现代法治国家的核心,也是推进体育社会组织发展的关键因素。我国现阶段体育社会组织的发展受制于依法行政的发展,存在体育社会组织立法不健全、体育社会组织去行政化的现实困境、行政过多干预体育社会组织管理、传统文化对体育依法行政的束缚以及体育体制改革与依法行政现实冲突等诸多问题。切实推进依法行政,形成国家与体育社会组织的良性互动,不仅有利于法治国家的构建,还有利于从根本上促进体育社会组织发展。

Law-based administration is the core of a modem nation of laws. It is also the key factor for promoting the development of sport social organizations. At present, the development of sport social organizations is enslaved to the development of law-based administration. There are quite a few problems such as imperfect legislation of sport social organizations, the real plight of de-ad- ministration of sport social organizations, excessive government intervention in the management of sport social organizations, the restraint of traditional culture to the law-based administration and the conflict between sport system relbrm and law-based administration. Effectively promoting the law-based administration and forming positive interaction between the state and the sport social or- ganizations are not only beneficial to the construction of a country of laws, but also to the promo- tion of the development of sport social organizations,
