论高校校内学生申诉中对校规的附带性审查

Incidental Review of School Regulations in Undergraduates' In-school Appealing

高校校内学生申诉制度是保护学生权益的重要途径之一,同时也是高校自我反省、依法治校的手段之一。当前学界对申诉制度的研究主要从组织结构、申诉程序、受理范围等方面入手,忽略了学生申诉中对校规进行附带性审查的可行性、必要性以及重大意义的相关研究。高校校规是高校法治的基石,但是当前校规普遍存在不合法、不合理之处。只有将校规的违法之处进行矫正,才能保证高校行为的合法性,防止侵犯学生权益。并且校内自我审查与外界监督相比,减少了一系列阻碍,可以对校规进行更加全面的审查。通过对校规的性质和校规的审查主体、审查方式、审查内容等的一系列研究,最终形成具体审查制度的构想,促进高校校内学生申诉制度进一步完善。

The system of undergraduate in-school appealing is one of the important approaches of protecting student rights and is also that of administering schools by law.The existing researches mainly focus on the organization,procedure,scope of application of the appealing system,neglecting the feasibility,importance and significance of incidentally reviewing the school regulations.College regulations are the footstone of school administration by law.However,some illegal or improper aspects are commonly found in college regulations.Only by rectifying these aspects,can we ensure the legitimacy of school conducts and protect student rights.The nature of school regulations,the subject of reviewing,the mode of reviewing and the content of reviewing are discussed with the purpose of constructing a solid system of reviewing and improving the system of undergraduate in-school appealing.
