摘要
我国地方人大及其常委会以国家权力机关和人民代表的身份,对立法、行政和司法进行全面的法律监督,具有其他监督方式无法比拟的权威性和优越性。但由于当前地方人大在监督职能的界定和权限划分方面不够清晰明确,造成法律监督权实际运行效果欠佳,出现立法监督职能不健全、行政监督力度疲软以及司法监督范围过宽等诸多问题。为了保障地方人大法律监督权的顺畅实施,首先应当厘清该监督权与其他方式的监督权之间的关系,同时准确划定其在立法监督、行政监督以及司法监督中的权限范围,有效解决监督"过宽"和"过窄"并存的问题。
Chinese local people's congress and its standing committee have the right of legal supervision towards "The People's Government, The People's Court and The People's Procurator". This form of legal supervision have played an incomparable authority and execution power in the process of operation with respect to other means of supervision. In this system, the boundary between local people's congress's supervision rights and other kinds of supervision rights is not very clear. There still exist several problems such as deficiency. The proper way of exercising the supervision right of local people's congress depends on drawing a proper precisely delimiting its position in legislative supervision, administrative supervision and judicial supervision; effectively solving the double contradictions between "too broad" and "too narrow" in the scope of supervision, in order to ensure the smooth execution of the legal supervision right of local people's congress.
