警察法学基础理论是警察立法不可或缺的理论支撑。当前,我国《人民警察法》的修改应当在深入研究警察法学基础理论的基础上形成对其基本定位、结构安排以及具体制度的设计。同时,《人民警察法》的修改应当积极回应和适应当前我国建设法治国家,推进国家治理能力治理体系现代化的要求,体现尊重和保障人权的宪法精神。严格遵循立法程序,规范立法语言,保障警察法的合法性。

The basic theory of police law review is an indispensible theoretical support for police legislation. At present, the revision of the police law of our country should make the design of its basic positioning, structure ar- rangement and specific system on the basis of in - depth study of the basic theory of police law review. Meanwhile, the amendment of police law should respond positively and adapt to the requirement of constructing a legal state and advancing the modernization of national governance capacity and system, and embody the constitutional spirit of re- specting and guaranteeing human fights. The amendment should follow strictly the legislative procedure, standardize the legislative language and safeguard the legitimacy of police law.
